The two Liugong excavators and other mining equipment confiscated from illegal miners who were operating in the Boin Forest Reserve were to be released to the owners. This decision was a ruling by the Enchi District Court presided over by the judge, Lawrence Buenor Buer on the 28th day of March, 2025.
Surprisingly, the same court has overturned the ruling today April 2, 2025. The judged explained that the previous ruling was erroneous as the court has no jurisdiction to take such decision. The judge cited two supreme court rulings as precedence to buttress this decision. These referenced cases were Moshie vs. Begyina (1963) and Attoh vs Okpoti (1973). Thus, he emphasized that courts can correct their own flaws.
The court further asked the Forestry Commission and the Enchi Police Command to take custody of the said machines and equipment.
